THEREFORE, IT IS HEREBY ORDERED that said Transfer of Permanent Legal and Physical Custody be heard by the Court at the Washington County District Courthouse, Stillwater, Minnesota, on June 16, 2023, @ 3:20 p.m. via Zoom, or as soon thereafter as the matter can be heard, and on any subsequent hearing dates set on this matter.

In the matter of the petition for the boundary change between the Brown’s Creek Watershed District (BCWD) & the Carnelian-Marine-St. Croix Watershed District (CMSCWD), pursuant to Minn. Stat. §103B.215.

Whereas, the subject petition and complete supporting documentation were received on February 22, 2023, and served on the Board of Water and Soil Resources (Board) pursuant to Minn. Stat. §103B.215. The Board has reviewed the petition for conformance with state law and rule.

Now therefore, the Board hereby issues the following:

NOTICE IS HEREBY GIVEN that the Board invites written comments on the petition for a boundary change. All comments received will be considered before a decision is made to change the boundary. Any person who objects to the petition may submit a written request for hearing to the Board. If no written requests for a hearing are submitted within 20 days of the last publication of this notice of filing, the Board will consider all of the comments and information received pertaining to the petition and make a decision on the boundary change at a regular Board meeting without conducting a public hearing.

The proposed boundary change encompasses approximately 600 acres of land in Washington County, Minnesota that would correct the watershed designation of 226 parcels at various locations along the common boundaries of the watershed management organizations.

Notice is hereby given that an application for informal appointment of personal representative has been filed with the Probate Registrar. No will has been presented for probate. The application has been granted.

Notice is also given that the Probate Registrar has informally appointed the following: Timothy John Markfort, 10524 Florida Ave. N., Brooklyn Park, MN 55445 as Personal Representative of the Estate of the Decedent. Any heir, devisee or other interested person may be entitled to appointment as Personal Representative, or may object to the appointment of the Personal Representative. Unless objections are fled pursuant to Minn. Stat. §524.3-607, and the court otherwise orders, the Personal Representative has full power to administer the Estate, including, after 30 days from the date of issuance of letters, the power to sell, encumber, lease or distribute real estate.

- Board workshop for an overview of the County Attorney’s Office.

Community Services

- Approve an application for the Mobile Crisis Home and Community Based Service Federal Medical Percentage (HCBS-FMAP) and American Rescue Plan Act (ARPA) funding from the Minnesota Department of Human Services in the amount up to $325,000.

General Administration

Approval of the following actions:

- Cliff Bujold, Lake Elmo, expressed his disappointment and concerns regarding the board’s decision on April 18 to connect County Road 15/Manning Avenue with 58th Street.

- April 11, 2023, County Board meeting minutes.

- Appoint Sandra DelCaro, Cottage Grove, to a partial term on the Historic Courthouse Committee as a District 4 representative, with a term expiring December 31, 2023.

- Resolution No. 2023-037, reappointment of Wayne H. Sandberg as County Highway Engineer.

- Resolution No. 2023-044, 1st quarter 2023 donations for $3,365.61.

- Deputy County Administrator Jan Lucke reported on state legislative updates, including a press conference scheduled this week regarding transportation principles. 

- A letter from the County Board will be sent to Governor Tim Walz requesting that Washington County be declared a State Disaster, which authorizes State Disaster Assistance.

Taxpayer Services

Approval of the following actions:

- Application from the Afton Bayport Lakeland Lions Club to conduct off-site gambling at the Washington County Fairgrounds, August 2-5, 2023.

- Application for a 1-4 day Temporary On-Sale Liquor License from VFW Post 323 for the Washington County Fair at the Washington County Fairgrounds, August 2-6, 2023.

- Application for a 1-4 day Temporary On-Sale Liquor License from the Stillwater VFW Post 323 for the Annual Mopars in the Park event, June 2-4, 2023, to take place at the Washington County Fairgrounds, 12300 N. 40th Street North in Baytown Township.

Public Works

Approval of the following actions:

- Resolution No. 2023-038, enter into Agreement No. 1052490 with the State of Minnesota, Department of Transportation (MnDOT) for Central Greenway Trailhead funding.

- State of Minnesota Agency Agreement for Federal Participation in Preliminary Engineering.

- Resolution No. 2023-041, enter into Agreement No. 1050364A01 with MnDOT to transfer the jurisdiction of Trunk Highway (TH) 96 within Washington County.

- Agreement No. 1050364A01 between the state and the county to transfer the jurisdiction of TH 96 (Dellwood Road), from TH 244 (Dellwood Avenue) to TH 95 (Broadway Street), a 9.0 mile segment.

- Contract No. 15475 for $308,069.90 with McNamara Contracting for the County State Aid Highway (CSAH) 13 and 4th Street North/Hudson Blvd Signal and ADA Improvement Project.

- Reject the bids received for Carpentry and Miscellaneous Metals scope of work for the Historic Courthouse Exterior Improvement Project.

- Resolution No. 2023-042, proclaiming Friday, April 28 to be Arbor Day, and the month of May 2023, to be Arbor Month in Washington County.

Sheriff’s Office

Approval of the following actions:

- Resolution No. 2023-043, proclaiming May 7-13, 2023, as National Correctional Officers Week.

- Sheriff Dan Starry announced that Lt. John Warneke, Assistant Jail Administrator, is retiring after 30 years of service to the Washington County Sheriff’s Office, and presented Lt. Warneke with a Meritorious Service Award for his extraordinary service.

Washington County Community Development Agency

Approval of the following actions:

- Resolution No. 2023-039, Washington County’s 2023 Annual Action Plan for the Community Development Block Grant and HOME Investment Partnerships programs and authorizing submission of such grant request to the U.S. Department of Housing and Urban Development.

- Resolution No. 2023-040, amendments to Washington County’s 2019 and 2020 Annual Action Plans for the Community Development Block Grant and HOME Investment Partnerships programs and authorizing submission of such amendment request to the U.S. Department of Housing and Urban Development.

NOTICE OF PUBLIC HEARING

BY THE CITY PLANNING

COMMISSION

NOTICE is hereby given that the Planning Commission of the City of Scandia will conduct a public hearing on Tuesday, June 6, 2023 beginning at 7:00 p.m. or as soon thereafter as possible, to consider a request by Daniel Froiland for approval to rezone a property from Agricultural Preserve to Agricultural Core, and for a Minor Subdivision to be known as Froiland Addition. The proposed project will rezone and subdivide a parcel to create a buildable lot along County Road 52/Oakhill Road North.
