TOWN of MAY

WASHINGTON COUNTY,

MINNESOTA

Ordinance 2022-22

 

AN ORDINANCE ENACTING A TWELVE (12) MONTH MORATORIUM FOR THE CONSIDERATION OF ANY OPEN SPACE MAJOR SUBDIVISION CONCEPT PLANS OR PRELIMINARY PLATS

 

Section 1.  Background

 

WHEREAS, the Town periodically updates zoning and subdivision regulations to make such regulations conform to the policies and directions of the Comprehensive Plan and general Town policy objectives; and

WHEREAS, the Town’s Subdivision Ordinance allows for open space major subdivisions to have a density bonus of up to 25% the number of lots allowed under a yield plan; and 

WHEREAS, the Town Board wishes to conduct a study on the regulations related to open space subdivisions; and

WHEREAS, the Town seeks to ensure that the regulations are consistent with the spirit and intent of the Town Comprehensive Plan and Town policy objectives; and

WHEREAS, the study will include consideration of whether a density bonus is a desirable feature of open space subdivisions and if so whether the current bonus is at an appropriate and reasonable level and whether it should change or be eliminated; and

WHEREAS, to protect the planning process, the Town wishes to enact this interim ordinance for the development of property as an open space major subdivision.  

 

Section 2.  Authority

Pursuant to the authority of Minn. Stat. Sec. 462.355, Subd. 4, a municipality is permitted to adopt an interim ordinance prohibiting development within its jurisdiction, or any portion thereof, until such time as amended official controls are adopted.  The interim ordinance is not to exceed one (1) year from the date it is effective.

 

Section 3.  The Ordinance

NOW THEREFORE THE MAY TOWN BOARD DOES HEREBY ORDAIN the enactment of a twelve (12) month moratorium for consideration, submission, processing or approval of any inquiries or applications for the establishment of open space major subdivisions.  

This ordinance does not delay or prohibit any permit or subdivision that has been given approval nor extend the time for action under the 60-day rule with respect to any application filed prior to the effective date of this interim ordinance.  

Pending the completion of the study referred to above, no open space major subdivision concept plan or preliminary plat application for development shall be processed or approved, and no applications for such approval will be accepted.  

BE IT FURTHER ORDAINED that the May Town Board hereby directs Staff is hereby directed to study the consistency of the Town’s open space major subdivision regulations with the Comprehensive Plan and Town policy objectives.  

 

Section 4.  Effective Date

This ordinance becomes effective upon passage and publication according to law.
