BID SECURITY: A Proposal Bond in the amount of not less than 5 percent of the total amount bid, drawn in favor of City of Scandia shall accompany each bid.

OWNER’S RIGHTS RESERVED:  The Owner reserves the right to reject any or all bids and to waive any irregularities and informalities therein and to award the Contract to other than the lowest bidder if, in their discretion, the interest of the Owner would be best served thereby.

NOTICE IS HEREBY GIVEN to the qualified voters of the Town of May, County of Washington, State of Minnesota, that the Annual Election; Annual Town Meeting; and Board of Canvass will be held on Tuesday, March 9, 2021.  In case of inclement weather, the Election, Annual Town Meeting, and Board of Canvass may be postponed until March 16, 2021.

NOTICE IF HEREBY GIVEN, that the Election will be held from 7:00 a.m. to 8:00 p.m.  Any voter who has not registered may do so at the election before voting.  The Election will take place at the May Town Hall located at 13939 Norell Avenue North.

Ordinance No. 2021-01

AN ORDINANCE AMENDING THE TOWN OF MAY SUBDIVISION & ZONING ORDINANCE

REGARDING MINIMUM LOT FRONTAGE AND EXEMPTED DIVISIONS

Section 1. Findings.

WHEREAS, the Town of May (the “Town”) recognizes the importance of zoning and subdivision regulations as a key factor in the protection of the health, safety, and welfare of the Town; and

WHEREAS, the Town seeks to ensure that all properties in the Town are able to be safely accessed, provide for proper waste disposal, meet requisite zoning, subdivision, and density standards, and do not create safety or environmental hazards; and

WHEREAS, the Town seeks to ensure that all new divisions of land are meeting the Town’s Comprehensive Plan.

NOW THEREFORE, THE TOWN BOARD OF THE TOWN OF MAY, WASHINGTON COUNTY, MINNESOTA DOES ORDAIN:

Section 2.  Code Amended.  Section 705.20.A.1 (e) is hereby amended to read as follows:

(e) Subdivision of Lots. Any lot or parcel of land subdivided by any means after the effective date of this code, for purposes of erecting a structure, or upon which a structure is proposed to be placed, must be first approved as required by the Town Code by the Town Board.  No structures shall be erected or building permits issued for parcels created through a statutory exception to the Town’s subdivision requirements unless the applicant demonstrates, to the satisfaction of the Town, that the property meets all minimum development standards and ordinances of the Town Code including but not limited to density, road frontage, access, zoning, and subdivision standards of the Town through the process stated in Section 901.04.26.

Section 3.  Code Added.  Section 705.20.A.1 (i) is hereby added to read as follows:

(i) Road Frontage Required.  No structures shall be erected or building permits issued for any structure on a parcel of land unless it has the required feet of frontage on a maintained public road or Town approved private street.

Section 4.  Code Amended.  Section 708.01.E.4 is hereby amended to read as follows:

4. Minimum Lot Width at Front Yard Setback Line – 150 feet

(a) No lot shall be less than 150 feet in width at the front yard setback line.

(b) Lots 4 acres in size or less shall have a minimum of 160 feet of public road frontage except as provided in (d) below.

(c) Lots greater than 4 acres in size shall have a minimum of 300 feet of public road frontage.

(d) Lots with frontage exclusively at the end of a cul-de-sac shall have a minimum of sixty (60) feet of public road frontage and meet the lot width requirement in (a) above.

Section 5. Code Amended.  Section 708.02.E is hereby amended to read as follows:

E. Physical Standards.  All construction in the Rural Residential District shall meet the following Physical Standards:

1. Height.  The maximum height of all buildings shall not exceed the lesser of two and one-half (2 1/2) stores or thirty-five (35) feet.  This height limitation shall not apply to farm buildings, grain elevators, silos, windmills, elevator legs, cooling towers, water towers, smokestacks, electric transmission lines or wind generators.

(a) Density Per Dwelling Unit One Family Structure - 10 Acres

(b) Minimum Lot Area Per Dwelling Unit on Approved Soils  - 2 1/2 Acres

(c) Minimum Lot Width at Front Yard Setback Line - 150’ 

(d) Lot Depth - Maximum of Four Times the Width at Front Yard Setback Line

2. Setbacks.  All buildings and structures, including houses with attached garages shall meet or exceed the following setbacks.

Section 6.  Code Amended.  Section 708.03.D.2 (b) is hereby amended to read as follows:

(b) Minimum Lot Width at Front Yard Szetback Line for Residential Uses – 150 feet

i. No lot shall have less than 150 feet at the front yard setback line.

ii.Lots 4 acres in size or less shall have a minimum of 160 feet of public road frontage, except as provided in iv. Below. 

iii. Lots greater than 4 acres in size shall have a minimum of 300 feet of public road frontage.

iv. Lots with frontage exclusively at the end of a cul-de-sac shall have a minimum of sixty (60) feet of public road frontage and meet the lot width requirement in (i) above.

Section 8.  Code Added.  Section 901.04.26 shall be added to read as follows:

901.04.26No building permit will be issued on any lot in a subdivision as defined herein which has been approved for subdivision until all requirements of this Ordinance have been fully complied with. No building permit will be issued for parcels created through a statutory exception to the Town subdivision requirements unless the applicant demonstrates, to the satisfaction of the Town Board, that the property meets all minimum development standards of the Town through the following process:

A. The applicant shall submit a survey of the division with the required submittals for a minor subdivision as identified in Section 901.15 including but not limited to, a yield plan.

B. The Town Board shall review the division and determine if it meets the Town’s Zoning and Subdivision regulations and is eligible for the erection of structures and/or the issuance of building permits.

C. Such division shall not establish or intensify any non-conformity in accordance with the Zoning or Subdivision Ordinance.

Section 9.  Effective Date.

This ordinance shall be in full force and effect from and after its passage and publication according to law.   

Section 10.  Severability.

If any part of this ordinance is held invalid by a court of competent jurisdiction, this shall not invalidate any other section, provision or part thereof.

NOTICE OF PUBLIC HEARING

BY THE CITY PLANNING

COMMISSION

 

NOTICE is hereby given that the Planning Commission of the City of Scandia will conduct a public hearing on Tuesday, March 2, 2021 beginning at 7:00 p.m. or as soon thereafter as possible, to consider the following:

Amendments to the City of Scandia Development Code regarding Temporary Farm Dwelling, to modify the existing standards for this use found in Chapter 2, Section 4.28. Amendments being considered include, but are not limited to, reducing the size of the property where a temporary farm dwelling is allowed and expanding the zoning districts where this use is permitted.

Anyone wishing to express their opinion on this proposal will be heard at the public hearing.  Given the current protocols for social distancing during the Covid 19 situation, the meeting will be held via online video and phone conferencing.  Submit written comments concering this application to mail@ci.scandia.mn.us. To participate in the online meeting, call City Hall at 651-433-2274 by 4:00 pm on Monday, March 1, 2021 to register for the video conferencing.
